Los Angeles Car Accident Lawyer

Has a vehicle wreck plunged your life into chaos? Put your world back in order by partnering with a Los Angeles auto injury attorney at the Law Offices of Gary K. Walch, a Law Corporation.

The traffic in Los Angeles might just be the worst in the world. Traffic means accidents and accidents mean injuries and even fatalities. Regardless of what brought about your auto wreck, if you weren’t the one who caused it, you may be owed financial compensation. Filing an auto wreck claim could help you hold a negligent driver accountable for your accident.

A Los Angeles car accident lawyer at our firm knows how to investigate auto wrecks and determine who’s to blame. They can assist you with collecting evidence and proving the fault of the person responsible. All auto injury claims are not simple, and having a legal professional on your team could make a big difference in your case’s outcome.

Known Causes of Vehicle Wrecks in Los Angeles

Auto accidents are caused by many things, and if negligence played a role in your collision, you could be owed a car accident settlement. Negligence is a term used to describe a person’s careless actions. If those careless actions bring about injury to others, the responsible person can be held liable according to civil laws in California.

Figuring out the cause of your vehicle crash is important. The cause indicates who was responsible for the crash. It’s then necessary to collect evidence to prove the cause and who was at fault. Below is a list of known causes of auto collisions in the Los Angeles area.

  • Distracted Driving – Engaging in distracted driving is known to be dangerous, yet people continue to do it every day. Cell phone use, eating, putting on makeup, and changing the radio station are examples of distracted driving.
  • Poorly Designed Roads and Intersections – You may not realize how the streets you drive on can contribute to vehicle collisions. If streets aren’t maintained, bushes aren’t trimmed, and roads aren’t designed properly, accidents couldresult.
  • Impaired Driving – Intoxicated driving is known to be dangerous and often causes serious injury accidents. Despite the well-documented risk involved in driving impaired, some people just don’t care about the danger they pose to others.
  • Defective Auto Parts – You might not realize that your vehicle’s parts can lead to collisions. If your vehicle isn’t functioning the way it should, the malfunction could cause a collision. You could be injured because of defective auto parts.
  • Poor Vehicle Repairs – Most drivers aren’t mechanics, and they trust that the mechanic they hired to fix their vehicle did a good job. If the mechanic is negligent and doesn’t service your vehicle properly, the vehicle could malfunction leading to a collision.
  • Reckless Drivers – They’re out there—dangerous drivers. The drivers who speed constantly, weave in and out of traffic, lay on their horns, and blow through red lights. They cause accidents regularly, and they could be held liable for accidents they cause.

Going After the Person Responsible for Your Los Angeles Crash

Once you figure out what caused your accident, you will most likely know who was to blame. For instance, if defective brakes caused your crash, it’s likely that a negligent manufacturer is liable for your accident. Once you know the who, you can file your injury claim against that person.

Your LA auto injury lawyer can help you to put your evidence together and complete the claim paperwork. They can assist you with adding up your losses and determining how much compensation you need to make things right. Once your claim is ready, you can send it in to the negligent person’s insurance company.

Dealing with insurers can be a challenge, but you might not even have to deal with this step. If you have an attorney, they can handle communications for you. This protects you from insurers who might try to get you to say something that would harm your claim.

Injuries and How They Impact Your LA Auto Injury Claim

Vehicle wrecks cause an array of injuries. Every crash is different and every injury will affect people differently. No two broken legs are the same, which means your car accident case is unique. The injury and suffering you went through because of someone else’s careless actions should be considered, and you could be compensated accordingly.

Some injuries are more serious than other types of injuries. Naturally, the more serious the injury, the more compensation you are owed. Why is this? Because you will have suffered greater damages. These types of damages are common in commercial trucking accidents

For instance, someone who suffered a traumatic brain injury in Los Angeles could deal with the effects of their injury for the rest of their life. They might be owed more compensation than someone who broke their arm.

The person who broke their arm could eventually return to a state of health equivalent to what they had before the accident. The person with the traumatic brain injury might never be the same again.

Some injuries that are known to lead to extensive losses and suffering for car accident victims are head injuries, severe burns, organ damage, broken bones, limb loss, and eye injuries.

Obtaining a Settlement for a Los Angeles Vehicle Collision

The insurance company that works for the at-fault party could agree to settle your claim. If they can clearly see that their insured was to blame for causing the accident, it’s likely they will agree to settle. That’s why evidence is so important—it can save you a lot of headache later on.

Your claim should also clearly show the suffering and monetary costs associated with your accident. For instance, you should have documentation in your claim that shows how much income you lost due to your accident. You should also have proof of your other financial losses. This will keep the insurer from challenging your right to compensation.

For auto and motorcycle wreck claims, you can also request payment for the trauma of your experience. For example, you can ask that you be financially compensated for the pain of your injuries and the mental suffering your accident caused you. A Los Angeles car crash attorney can assist you with calculating your losses and providing evidence to the insurer.

The following is a list of damages you could request in an auto injury claim:

  • Pain and suffering
  • Medical treatment expenses
  • Lost income and lost earning potential
  • Mental trauma
  • Mental health services
  • Property damage
  • Transportation expenses
  • Lost life enjoyment
  • Scarring and disfigurement

How An Attorney Can Help After a Riverside Car Accident

When you are injured in a car accident caused by another person, it can be extremely frustrating. Not only do you have to deal with the pain caused by physical injuries, but you are also likely worrying about many other things such as how to pay for your medical bills, what to do about missing work, what to do about your car, and how to move forward after the accident. Even if you feel like you deserve to be compensated for your injuries, the thought of bringing a personal injury claim against the person responsible can feel overwhelming. This is why it is so important to contact a skilled Riverside car accident attorney right away if you are injured in a car accident.

How an Attorney Can Help

A skilled Riverside car accident attorney can be very helpful when you have been injured in a car accident. While you focus on your physical recovery, your attorney can handle the rest and help ease your worries. An attorney can help you by:

  • Conducting an investigation: when you bring a personal injury claim, you will need to prove that your injuries came from the car accident, and that the car accident was caused by the intentional or negligent acts of another person. Sometimes, getting this proof of fault requires an investigation–looking for witnesses, video footage of the accident, and getting accident reports. A skilled attorney can help handle this investigation.
  • Dealing with insurance companies: After you are involved in an accident, you will likely have to deal with the insurance company of the party at fault. This can feel overwhelming as sometimes insurance companies try to pressure you into accepting low compensation for your injuries. When you have an attorney, the attorney can handle conversations with the various insurance companies involved.
  • Bringing Your Personal Injury Claim: Your attorney can move forward with the filing of your personal injury claim and negotiation for your damages. The goal of the claim is to help you get legal damages, or financial compensation, for your injuries. It is possible to get damages for your medical care expenses, lost wages and earning capacity, as well as other damages available under California law. An attorney can help get everything ready and ultimately filed so you can move toward getting your recovery.

What Should I do if I am injured in a Santa Clarita Car Accident?

After months of staying at home, many Santa Clarita businesses are opening back up, people are returning to work, and more people are participating in outdoor activities. As more people begin to go out, it means more cars on the road. As always, it is important to be careful and drive defensively to avoid getting in a car accident on Santa Clarita roads.

Car accidents are always frightening and can be very frustrating, if you are injured as a result. If you are injured in a car accident, there are a few things you will want to do right away:

  • Contact law enforcement to get an incident report: It is always important to contact the police after you are involved in a car accident. When officers arrive at the scene, they can create a report detailing what happened. For example, the report can detail the location of the cars, how the cars hit, and note things like whether there was a stop sign or medical help was needed. This report can be very helpful if you are injured, because it can be used to support your personal injury claim to get compensation for your injuries.
  • Get medical attention: When you are involved in a car accident, it is always important to get medical attention to check for injuries. In some cases, your injury may be obvious like with more serious injuries such as a broken arm or a broken leg. In these cases, you will definitely go to the hospital or doctor. However, in some cases, though you may not feel injured right away, you may actually be suffering from very painful injuries. For example, you may experience back or neck pain after a crash, even if it was not immediately noticeable. By getting medical attention, a doctor can check to see if you do have injuries and provide proper treatment if you need it. You may need physical therapy to get you back to good health. Visiting the doctor right away can also be helpful in showing your injuries when you seek compensation.
  • Talk to a Santa Clarita car accident lawyer: When you are injured in a car accident, you will want to get in touch with a skilled Santa Clarita car accident lawyer right away. This is important because a knowledgeable lawyer will be ready to walk you through what to do as you move forward after your accident. They can explain the personal injury claim process–a personal injury claim is brought against the person or party responsible for your injuries and you can receive financial compensation, called legal damages, for your injuries. A lawyer can also handle all dealings with insurance companies. Insurance companies may try to get you to settle for less than you deserve, so you will want the help of a skilled lawyer.

Ventura DUI Car Accident Results 1 Death, 1 Injured

When a car accident results in injuries or death it is always tragic. When the crash occurs because someone was driving while intoxicated, it can be even more frustrating as these accidents are totally preventable.

Recently, KTLA News 5 reported that a rear end collision occurred in Ventura County just outside of Oxnard. A 2017 Nissan Rogue was stopped at a red light when a 2000 Lexus RX300 slammed into the back of the car. The force of the collision sent the Nissan into the center median, and the Lexus flew off to the side of the road.

The crash caused significant damage to the vehicles and harm to those inside. Those in the Nissan included a 41-year-old woman and a 14-year-old boy. Emergency personnel responded, but the woman died at the scene. The young boy was taken to the hospital with major injuries.

Officers are still investigating what caused the Lexus to collide with the Nissan, but they believe the driver was likely driving under the influence. She also suffered major injuries in the incident, and was later “placed under arrest for suspicion of driving under the influence.”

If the investigation confirms that the driver was driving under the influence, the driver will face criminal charges. However, in addition to criminal charges, the driver will be civilly liable to those she harmed due to her decision to drive under the influence. Those harmed due to this incident should talk to a car accident attorney in Ventura to help them bring a civil claim against the driver. In this case, a couple different claims can be brought against the driver:

  • Wrongful Death Claim: The family members of the woman who died in this accident can bring a wrongful death claim against the driver responsible for the death of their loved one. A wrongful death claim can help the family members of the victim with the costs associated with the funeral and burial of their loved one, as well as the other damages such as lost wages and loss of companionship.
  • Personal Injury Claim: The young boy injured in this accident can also be compensated for his injuries. When a serious car accident occurs, the injuries are often much more severe. Not only do these types of injuries require costly hospital visits, but usually require a lengthy recovery process that often involves physical therapy. A personal injury claim can allow the victim to be financially compensated for medical costs, recovery expenses, as well as other damages such as pain and suffering and costs associated with mental health care required due to the accident.
